Our office is very aware of the domestic violence law in the State of Florida. Basically, the police officer will often make an arrest if they see visible signs of injury to one party and they think they can prove who the primary aggressor was. In many instances both parties will get arrested and then the case is left to the State Attorney’s Office for prosecution. Many people are not aware that the State Attorney’s Office can go forward on their case even if the victim declines to prosecute. less
